These Terms of Service ("Terms") govern your use of theauctionking.ai (the "Site") and the products and services offered by The Auction King ("we," "us," or "our"). By accessing the Site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site or purchase our products.

2. Our products and services

We offer digital educational products, including the Government Auction Resale Manual and a free starter chapter, as well as a paid private mentoring service. Our content is educational and informational in nature. See our Disclaimer for important information about results and the educational nature of our materials.

3. License to use digital products

When you purchase a digital product, we grant you a limited, personal, non-exclusive, non-transferable license to access and use it for your own personal, non-commercial educational use. You may not copy, resell, redistribute, share, sublicense, publish, or create derivative works from our products or content without our written permission.

4. Intellectual property

All content on the Site and in our products — including text, graphics, logos, the "The Auction King" name and branding, and the manual itself — is owned by us or our licensors and is protected by copyright and other laws. Nothing in these Terms transfers ownership to you.

5. Pricing and payment

Prices are listed in U.S. dollars and may change at any time. Payments are processed securely by our third-party payment provider (Stripe). By submitting a purchase, you authorize the charge to your selected payment method.

6. Refund policy

Because our products are digital and delivered to you immediately, all sales are final and non-refundable. If you experience a technical problem — for example, a file that won't download or appears corrupted — contact us at service@theauctionking.ai within 14 days of purchase and we will work to fix or replace it.

7. Private mentoring

Our private mentoring is a paid service involving guidance and coaching. It does not guarantee any specific outcome or result. Scheduling, availability, and any rescheduling or cancellation terms will be communicated when you book. Mentoring fees are subject to the refund terms communicated at the time of purchase.

8. Disclaimers; no warranties

Our products and the Site are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free. We make no guarantee of income, profit, or results. Please read our Disclaimer, which is incorporated into these Terms.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost data, arising from your use of the Site or our products. Our total liability for any claim will not exceed the amount you paid us for the product or service giving rise to the claim.

10. Your responsibilities & assumption of risk

Buying and reselling goods — including at government auctions — involves financial risk. Auction items are typically sold "as-is." You are solely responsible for your own decisions, bids, purchases, compliance with applicable rules and laws, and any taxes owed. You agree to do your own due diligence.

11. Third-party platforms and links

We reference and may link to third-party auction platforms and websites (such as government auction sites). We are not affiliated with, endorsed by, or responsible for those platforms, their content, or your transactions on them.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or products, your violation of these Terms, or your violation of any law or third-party right.

13. Governing law

These Terms are governed by the laws of the State of Louisiana, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Louisiana.

14. Changes to these Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest version. Continued use of the Site after changes means you accept the updated Terms.
